Determining the validity of these allegations ultimately rests on the shoulders of the Public Utilities Commission of Texas (PUCT), which has acknowledged “concern” over the reports. The power to switch is all about knowing your rights as an electric customer. In Texas, the electricity market is deregulated. Instead of only being able to get electricity from the utility and then paying the rates the utility requires, Texas retail electricity providers buy energy from generators at wholesale prices. Providers then compete with each other to offer consumers more options in terms of their electricity plans. Every electricity consumer in Texas' deregulated markets has to choose a retail electricity provider, but once you choose you don't have to stay with that provider forever. You have the power to switch electricity providers to find the best service and the best rates to meet your electric needs.
The Electric Reliability Council of Texas (ERCOT) does it for you. When you sign up for a plan with a new provider, ERCOT will send you a mailer confirming the switch. You have three days upon receiving the mailer to change your mind. If you don't, you'll have a new provider within seven days, and ERCOT will notify your old provider. Just remember, if you abandon a contract before it's complete, you will be on the hook for any fees or penalties detailed in its Terms of Service.
In environmental impact, results are mixed. With the ability to invest profits to satisfy further energy demand, producers like TXU are proposing eleven new coal-fired powerplants. Coal powerplants are cheaper than natural gas-fired powerplants, but produce more pollution. When the private equity firms Kohlberg Kravis Roberts and the Texas Pacific Group announced the take-over of TXU, the company which was known for charging the highest rates in the state and were losing customers, they called off plans for eight of the coal plants. TXU had invested more heavily in the other three. A few weeks later the buyers announced plans for two cleaner IGCC coal plants.
Fixed-rate plans: Fixed-rate plans give customers more stability for their monthly energy bills because the rate a customer signs up with is the rate he or she pays for the length of the plan’s contract. Most fluctuation comes with usage, though transmission and delivery charges and local fees also can change.. Because a fixed-rate plan sometimes spans two-three years, these plans often require a customer credit check and can include early cancellation fees. Fixed-rate plans, because of the continuing market volatility, probably are the best choice for many consumers.

One desired effect of the competition is lower electricity rates. In the first few years after the deregulation in 2002, the residential rate for electricity increased seven times, with the price to beat at around 15 cents per kilowatt hour (as of July 26, 2006, www.powertochoose.org) in 2006. However, while prices to customers increased 43% from 2002 to 2004, the costs of inputs rose faster, by 63%, showing that not all increases have been borne by consumers. Since Texas' electricity market was deregulated in the late nineties, multiple Retail Electric Providers (REP) have either launched in Texas, or providers in other states have begun to extend their reach to Texas residents (e.g., Spark Energy, which was founded in Texas). These electricity providers are providing less expensive and/or greener electricity alternatives to traditional sources of energy, in contrast with the supply consumers previously received by default through their local utility. Customers now have the option to receive their electric supply from providers other than their utility, known as alternative retail electric providers.

The complaints filed against providers aren't a perfect mirror of the J.D. Power customer satisfactions scores. Just Energy, which earned only two J.D. Power Circles and earned the second-lowest score, had only 21 complaints recorded with the Public Utility Commission. But it's helpful to view these complaints in aggregate: Over 50 percent of the 1,119 total complaints fall under "billing" — another reason to seek out a provider with high customer satisfaction in that area in particular.
