Electricity rates in Texas are not fixed. Your rate can vary greatly depending on your usage and your electric plan. Some plans have relatively flat rates, while others can be all over the place. This means that you could end up paying 7¢ for 999 kWhs and 8.5¢ for 1001 kWhs. That would be a 16% increase because you microwaved a few potatoes. Learn more on the different plan types here.
According to a typical economic theory, prices are optimally determined in a fair and transparent market, and not by a political or academic body. In deregulation of electricity markets, one immediate concern with pricing is that incumbent electricity providers would undercut the prices of new entrants, preventing competition and perpetuating the existing monopoly of providers. Thus, the SB7 bill introduced a phase-in period during which a price floor would be established (for incumbent electricity companies) to prevent this predatory practice, allowing new market entrants to become established. New market entrants could charge a price below the price to beat, but incumbents could not. This period was to last from 2002 to January 1, 2007. As of 2007 Texas investor owned utility affiliates no longer have price to beat tariffs.
Before you switch providers, you’ll need to determine whether you’re under a contract with your current provider, and if so, how long you have left on your contract. You can usually find this information by looking at your electricity bill or by calling your energy provider. If you choose to switch before your contract is up, your current contract may outline an early termination fee. However, according to the Public Utility Commission of Texas, customers can switch providers without paying an early termination fee if they schedule the switch no earlier than 14 days before their current plan expires. When you change providers, you’ll be able to indicate the date you want the switch to occur.
As a result, 85% of Texas power consumers (those served by a company not owned by a municipality or a utility cooperative) can choose their electricity service from a variety of retail electric providers (REPs), including the incumbent utility. The incumbent utility in the area still owns and maintains the local power lines (and is the company to call in the event of a power outage) and is not subject to deregulation. Customers served by cooperatives or municipal utilities can choose an alternate REP only if the utility has "opted in" to deregulation; to date, only the area served by the Nueces Electric Cooperative has chosen to opt in.
Fixed-Rate Plans: These plans are steady and predictable; the price per kWh you sign up for will remain that same for the entirety of your contract. (The only changes in your bill will be from forces outside of your REP's control, like changes in TDU fees, or changes in federal, state, or local laws.) Often fixed-rate plans will have a slightly higher price per kWh than others, but you're paying for the predictability. They're great if you live by your budget – and even greater if you happen to sign up when rates are low. The fixed-rate plans of our five Texas providers typically started at 12 months, with some extending up to three years, but we spotted a couple from Reliant that offered fixed rates for six month contracts as well.

Or ask a friend or relative to help you.) Enter your ZIP code and start searching. When you find an offer you like, make sure to go to the company’s website. Sometimes the company’s price might be cheaper than what’s shown on powertochoose.org.
In this free market competing electricity retailers buy electricity wholesale from private power generators to sell at retail to around 85% of Texas residents. The partnership between generators and retailers is governed by the Electric Reliability Council of Texas, or ERCOT, which attempts to balance the power grid’s electricity supply and demand by purchasing small amounts of electricity at 15-minute intervals throughout the day.
